Introduction
Welcome to Amplify Web Hosting (“Amplify,” “we,” “us,” or “our”).
These Terms and Conditions (“Terms”) govern your access to and use of Amplify’s websites, hosting services, related software, tools, and any other services provided by us (collectively, the “Services”).
By accessing or using our Services, you agree to be bound by these Terms and all applicable laws. If you do not agree, please do not use the Services.
We may update these Terms from time to time — see §19 below for details.
Eligibility
To use our Services, you must:
Be at least 18 years old (or the age of legal majority in your country);
Have the legal authority to enter into binding agreements; and
Use the Services in compliance with these Terms and applicable laws.
By using our Services, you represent and warrant that you meet these requirements.
Account Registration and Security
You may need to create an account to access certain Services.
Accuracy: You agree to provide accurate, complete, and current information.
Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
Unauthorized Use: Notify us immediately at support@amplifywebhosting.com
if you suspect unauthorized access.
Termination: We reserve the right to suspend or terminate accounts that are inactive, compromised, or violate these Terms.
Services and Availability
Amplify provides website hosting, domain management, and related digital infrastructure.
Uptime: We strive for high availability but do not guarantee uninterrupted or error-free service.
Maintenance: We may perform maintenance or updates, which may temporarily affect access.
Third Parties: Some functionality may rely on third-party infrastructure (e.g., Framer hosting, Stripe payments, analytics tools). Amplify is not responsible for third-party service interruptions beyond our control.
Acceptable Use Policy (AUP)
You agree not to use the Services for unlawful, abusive, or harmful purposes, including but not limited to:
Hosting or distributing malware, spam, or phishing sites;
Infringing copyrights, trademarks, or other intellectual property rights;
Violating privacy rights or data protection laws;
Hosting content that is hateful, violent, pornographic, or discriminatory;
Interfering with network security or attempting unauthorized access;
Reselling our Services without permission.
Amplify reserves the right to suspend or terminate any account violating this AUP without notice.
Customer Content and Ownership
You retain full ownership of the content, data, and materials you upload or host (“Customer Content”).
By using the Services, you grant Amplify a limited, non-exclusive, worldwide, royalty-free license to host, reproduce, and process Customer Content solely to provide the Services.
Amplify does not claim ownership over your content. You are responsible for ensuring your content complies with laws and these Terms.
Data Protection and Privacy
Your privacy is important to us. Our Privacy Policy
explains how we collect, use, and protect your personal data.
When you host websites or apps using Amplify, you act as the Data Controller for your end-users’ data, and Amplify acts as your Data Processor under applicable data protection laws (see §15 of our Privacy Policy).
Payments and Billing
Processor: All payments are handled securely through Stripe.
Billing cycles: Charges occur monthly or annually, depending on your plan.
Taxes: Prices may exclude applicable taxes (VAT, GST, etc.), which will be added where required.
Refunds: Refunds are handled in accordance with our refund policy (if applicable) and local law.
Late or failed payments: May result in service suspension or termination.
Amplify reserves the right to adjust prices with reasonable notice.
Free Trials and Promotions
We may offer free trials or promotional pricing. These are subject to change or cancellation at our discretion.
At the end of a trial, paid subscriptions may automatically renew unless you cancel before the renewal date.
Intellectual Property
All materials, trademarks, designs, logos, and software forming part of the Amplify Services are the exclusive property of Amplify Web Hosting or its licensors.
You may not:
Copy, modify, or distribute our intellectual property without written consent;
Reverse-engineer or attempt to extract source code from our software;
Remove or obscure copyright, trademark, or ownership notices.
Third-Party Services and Links
Our Services may include links or integrations with third-party tools (e.g., Framer, Stripe, analytics providers).
Amplify is not responsible for the content, policies, or practices of third parties. You should review their terms and privacy policies before using their services.
Termination
You may terminate your account at any time via your dashboard or by contacting support@amplifywebhosting.com
.
Amplify may suspend or terminate your account if:
You breach these Terms or our Acceptable Use Policy;
Required by law or regulatory authority;
Payment is overdue; or
Continued operation presents a risk to our systems or users.
Upon termination:
Your access to Services will end;
Customer Content may be deleted after a grace period (see our retention policy);
Outstanding fees remain payable.
Service Modifications
We may modify, upgrade, or discontinue parts of the Services to improve functionality or security.
Material changes will be communicated in advance where practical.
Disclaimers
The Services are provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, Amplify disclaims all warranties, express or implied, including but not limited to:
Merchantability, fitness for a particular purpose, and non-infringement;
Continuous, error-free, or secure operation;
Accuracy or reliability of results.
You are responsible for maintaining your own data backups.
Limitation of Liability
To the fullest extent permitted by law:
Amplify shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, revenue, or goodwill.
Our total aggregate liability for any claim shall not exceed the total fees you paid to Amplify for the Services in the six (6) months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability for gross negligence, fraud, or willful misconduct.
Indemnification
You agree to indemnify, defend, and hold harmless Amplify, its affiliates, and employees from and against any claims, damages, liabilities, or expenses (including legal fees) arising from:
Your use or misuse of the Services;
Violation of these Terms or applicable law;
Infringement of any third-party rights.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of [Insert your company’s jurisdiction, e.g., Delaware, United States], without regard to conflict-of-law principles.
Disputes will first be attempted through good-faith negotiation.
If unresolved, disputes shall be submitted to binding arbitration (or, if not permitted, to the courts of that jurisdiction).
Nothing limits your rights under applicable consumer protection laws.
Force Majeure
Amplify is not liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, power failures, internet outages, strikes, acts of war, or governmental actions.
Changes to These Terms
We may update these Terms periodically. When we do:
The “Effective Date” at the top will be revised;
Material changes will be communicated via website notice or email.
Continued use of the Services after changes take effect means you accept the updated Terms.
